1.2.- Description

This Privacy and Cookies Policy governs the collection, processing and use of your personal and non-personal information as a User of the Service, as of the effective date shown in the header.

The Service does not sell your personal information to third parties and will always request your consent before using your data for any purpose other than those described in this clause.

To process your personal data, the Service complies with applicable local and European legislation and its implementing regulations.

Therefore, it adopts the necessary technical and organizational measures to prevent loss, misuse, alteration, unauthorized access and theft of the personal data provided, always in accordance with the state of the art, the nature of the data and the risks to which they are exposed.

2.- Information collected

The personal and non-personal information collected by the Service will vary depending on how you use the website and its features.

The personal and non-personal information collected by the Service will reach us through three channels:

  1. information collected automatically

  2. information you provide voluntarily, and

  3. information provided by third parties.

2.1.- Data collected automatically

This information will include:

  • Information collected through cookies or similar mechanisms stored on your device, always with your consent. See our cookies clause for more information.

  • The IP address from which the connection is made, the type of device used and its characteristics, the operating system version, browser type, language, date, country, request time, referrer URL, or mobile network used, among others.

  • Service usage data and possible errors detected during its use, such as pages not found or incorrect displays.

2.2.- Data provided voluntarily

This information will include:

  • The information contained in messages sent through the Service’s contact channels or when you subscribe to our newsletter. For example, your email, alias or name, subject or message.

2.3.- Data provided by third parties

This information will include:

  • Information provided by social networks or similar services.

3.- Rights

Please note that completing the forms is voluntary. However, if you do not fill in the required fields (marked with an asterisk), the use of certain Service functions will not be possible or will be limited.

The personal data you provide will be incorporated and processed in files owned by the Service, in order to handle your requests, provide the requested service, and keep you informed about matters relating to the company’s activity and services.

You may exercise at any time your rights of access, rectification, erasure, restriction of processing, objection and data portability by email addressed to: Cristalleria Vidres Arxiduc S.L. or by post to: C/ Arxiduc Lluis Salvador, 128, 07004 Palma de Mallorca.

In both cases you must identify yourself with your first and last name, as well as a copy of your national ID card or national ID.

Here you can find the different templates to exercise these rights.

If you have given consent for a specific purpose, you have the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent prior to its withdrawal.

In addition, if as a User you believe there is an issue with the way the Service is handling your data, you may lodge a complaint with the DPO or the relevant data protection authority, with the Spanish Data Protection Agency (AEPD) being the competent authority in Spain.

4.- Use of Data

The data provided to the Service will be used to:

  • Handle your requests.

  • If you have consented, send you our newsletter by email.

4.1.- In emails and contact forms

The Service’s website uses SSL encryption, allowing users to securely send personal data through standard contact forms.

The personal data collected will be subject to automated processing and incorporated into the corresponding records of processing activities, of which the Service is the controller.

In this regard:

  • We will receive your IP address, which will be used to verify the origin of the message in order to offer you appropriate recommendations (for example, displaying information in the correct language) and to detect possible irregularities (for example, possible cyber-attack attempts against the Service), as well as data relating to your ISP.

  • Likewise, you may provide us with your data by telephone, email and other communication methods indicated.

Regarding the communication channels used:

  • Our email service provider is Ionos.

On the other hand, certain services provided through the Website (for example, the possibility of participating in a contest or giveaway) may include specific data protection conditions. These must be accepted before participating in such services.

Finally, as already indicated, the purpose of processing these data will solely be to provide the information or services requested.

4.2.- On social networks

The Service has profiles on some of the main social networks on the Internet and is recognized as the data controller in relation to the data published on them (for example, photos uploaded by the Service in which people’s faces appear).

The processing that the Service will carry out on the data within each of these networks will, at most, be what the social network allows for corporate profiles. Thus, the Service may inform our followers—where not prohibited by law—through any channel that the social network enables, about its activities or offers, as well as provide a personalized customer support service.

In no case will the Service extract data from social networks unless the user’s specific and explicit consent is obtained for that purpose.

When, due to the nature of social networks, the effective exercise of the follower’s data protection rights depends on modifying the follower’s personal profile, the Service will help and advise you to that end to the extent possible.

4.3.- In giveaways

By participating in promotional actions organized exclusively by the Service, the data you provide will be processed only by us for the purpose indicated in the promotion’s terms.

4.4.- Job offers

The Service will only consider job or internship applications sent by the candidate through the channels indicated on the careers page or through the channels provided in job and internship areas on university websites where the Service has published a specific offer.

All other applications will be rejected.

The applicant authorizes the Service to analyze the documents sent, all content directly accessible via search engines, the profiles maintained on professional social networks, the data obtained in access tests, and the information disclosed in the job interview, in order to assess the application and, where appropriate, offer a position.

The Service may use duly anonymized data to produce statistics about the type of person applying as a candidate, with the idea of publishing reports on this.

5.- Data retention

Below is how long the data processed by the Service is retained:

  • Aggregated data will be retained with no deletion deadline.

  • Customer data will be retained depending on the contracted service. In any case, it will be the minimum necessary and may be kept for up to:

    • 5 years, pursuant to Article 1964 of the Spanish Civil Code (personal actions with no special time limit).

    • 6 years, pursuant to Article 30 of the Spanish Commercial Code (accounting books or invoices, for example).

  • Newsletter subscriber data will be retained from the time the user subscribes until they unsubscribe.

  • User data uploaded by the Service to social network pages and profiles will be retained from the moment the user gives consent until they withdraw it.

  • Candidate data for a job offer, if the candidate is not selected, will be retained for a maximum of two years to include them in future openings, unless the candidate objects.
